.In the constitution there is description of the process of appointment of 25 Judges and 1 Chief Justice. According the verdict in the case of Supreme Court Advocates-on-record Association (S.C.A.O.R.A)Vs Union of India in 1993, the appointment and transfer of the judges of the Supreme Court is a process by which the best available persons are appointed. The opinion of the C.J.I. will get preference. He is the only officer, without whose consent, no appointment to the Supreme Court is done. During times of conflict of constitutional powers, C.J.I. represents the Judiciary. President seeks a second look of the opinion of the C.J.I. only when there is enough logical reasons are availble to him. After such review, his opinion becomes bindig on the President. At his discretion, he can take opinion of other judges of the High Courts or Supreme court, but all such opinion is taken in writing. सुप्रीम कोर्ट एडवोकेट्स आन रिकार्ड एसो बनाम भारत संघ वाद 1993 मे दिये गये निर्णय के अनुसार सर्वोच्च न्यायालय उच्च न्यायालय के जजॉ की नियुक्ति तथा उच्च न्यायालय के जजॉ के तबादले इस प्रकार की प्रक्रिया है जो सर्वाधिक योग्य उपल्ब्ध व्यक्तियॉ की नियुक्ति की जा सके सी.जे.आई. का मत प्राथमिकता पायेगा वह एक मात्र अधिकारी होगा उच्च न्यायपालिका मे कोई नियुक्ति बिना उस की सहमति के नही होती है संवैधानिक सत्ताओं के संघर्ष के समय सी.जे आई. न्यायपालिका का प्रतिनिधित्व करेगा राष्ट्रपति सी.जे.आई. को अपने मत पर फिर से विचार करने को तभी कहेगा जब इस हेतु कोई तार्किक कारण मौजूद होगा पुनःविचार के बाद उसका मत राष्ट्रपति पे बाध्यकारी होगा यधपि अपना मत प्रकट करते समय वह सुप्रीम कोर्ट के दो वरिष्टम न्यायधीशों का मत जरूर लेगा पुनःविचार की दशा मे फिर से उसे दो वरिष्टम न्यायधीशॉ की राय लेनी होगी वह चाहे तो उच्च न्यायालय/सर्वोच्च न्यायालय के अन्य जजॉ की राय भी ले सकता है लेकिन सभी राय सदैव लिखित मे होगी
